Terms and Conditions

The following terms and conditions represent the agreement under which everythingIbiza.com enters into (the contract) with you the customer. everythingIbiza.com is a trading brand name of Clutch Time S.L., our official merchant name.

Please Note: Prices and other information are always subject to change in the preliminary stages of making a booking and only the prices quoted on your final confirmation can be taken as fixed.

What is Included:

Meals if applicable as specified at the time of booking.
Full Board - Breakfast, Lunch and Dinner
Half Board - Breakfast and Dinner (occasionally a hotel may offer Lunch instead of Dinner)
Bed and Breakfast - Breakfast
Room only - No meals included
Self Catering - Accommodation with basic cooking facilities

Accommodation will be according to the type you have booked as detailed on your booking.

What is Not Included:

Flights and transfers to and from the airport except where specifically booked.
Holiday Insurance which is compulsory and your responsibility to arrange. We remind you that holiday/travel insurance is an essential part of any holiday.
All items of personal expenditure not specified as being included for example car parking, optional excursions, hotel local charges e.g. Air conditioning, sunbeds, sports facilities, cots or any other activity or equipment.
Refundable damage deposit where charged by the hotelier.
Costs incurred due to damage caused to property by everythingIbiza.com customers.

Hotel Categories

Where available we use the official star ratings awarded by the Spanish authorities. They may not be comparable to ratings in other European countries, and the quality of the hotels within the same category can vary immensely. The awards are based on certain facilities or services being available, they do not generally take into account the size of the rooms or preferred decor of the owner. Hotels differ in size, location and character a good indication of quality is the price.
Typically a lot of the accommodation in Ibiza is family or privately owned or managed, these properties have the rating of Private.

Agro Turismo or Rural Hotels

Hotels described as above may have no star rating but this does not mean that they are any way inferior to the larger hotels. These terms are often used for country houses, farms or historical buildings. Many offer the standards of a 3 or 4 star hotel, but are generally family run with fewer services such as reception.

Hotel Accommodation

Accommodation in all hotels, whatever their grading is a standard room, unless otherwise specified.

Bedroom Facilities and Views

Descriptions apply to twin rooms unless otherwise stated and facilities may differ for other room types. Room facilities such as WC shower or bath are shown in the hotel description. In the case of balconies or terraces these may only be a feature of some room types. A terrace may be shared by more than one room, and a balcony may be described as a French or small balcony which will only be large enough to stand on. It is not normal practise to have tea and coffee making facilities in Spanish hotel rooms.

The photography may not reflect the room type that will be allocated to you, which may vary in size, style or decor from the room shown, but will have all facilities as booked.
When a room is described as being a sea view, this does not imply that the room directly faces the sea, but rather that the sea can be viewed from the window or balcony, this may be to the side or in the distance. Where sea views are described as front sea views this means that the room faces the sea, however the nature of the view will differ according to the position of the room and the view may still be distant.

Single rooms, despite the supplement paid for them may be of a lower standard to twin rooms or may lack some of the facilities. They may also be in a different location to the twin rooms described in the text.

Double rooms, often have two single beds pushed together in Spain, to be used as a double bed.
Triple rooms, these are usually on the basis of a twin room with an extra bed fitted. This is usually reflected in the price of the third person. The extra bed is often a fold-up bed and the rooms can seem quite cramped.

Suites and Junior Suites, these have seperate seating areas in addition to the sleeping area, in Suites this is normally in a separate room unless otherwise stated.

Meals

There is not a great variety of vegetarian meals available in Spain and a vegetarian menu would be on request. It is unlikely that the hotels offering food would be able to take into account special dietrary requirements.

Villas and Apartments

Cleaning normally takes place a minimum of once weekly (more frequently if stated). Linen and towels are also provided. Kitchens are not usually cleaned mid-holiday and it is the responsibility of the guest to leave the kitchen and equipment in good condition for the next guests.

Kitchen facilities where provided will usually consist of a minimum of two gas or electric rings, a refrigerator, cooking utensils, crockery and cutlery but not kettles or teapots.
Linen is generally everything with the exception of pool and beach towels and possibly tea towels. Gas, water and electricity charges are included.

Heating and Air Conditioning

Heating and Air conditioning will be mentioned where it is included in the cost of the rental. Where heating and air conditioning is available but not included it will be mentioned but either charged on booking or locally. Unless stated it is not usual for villas to be equipped with heating or air conditioning. The period of use for heating and air conditioning in hotels, villas and apartments is at the discretion of the the owner or management in compliance with the fuel saving requirements current in Spain.

Check in Times

Check in times Villas are not normally ready to accept guests until 16.00 on the first reserved night of their holiday. Check out is at 10.00. In hotels and some apartment complexes check out time is 12noon on the day of departure.
Please bear in mind that if you are travelling in the early hours of the morning, check out is deemed to be 10.00 or 12noon of the previous day unless you have booked an extra day or extended your reservation to depart later than the agreed check out time.

Breakage deposits are often required by our villa or apartment owners. This must be paid in cash or sometimes by credit card. In the case of any damages or breakages the cost will be taken from this deposit.

Swimming Pools

Please abide by the opening and closing rules of the swimming pool in your accommodation and take note of the depth markings where present. The majority of swimming pools in Ibiza are outdoor and unheated.

Satellite TV

Where we mention that an accommodation has satellite TV we make no guarantee of what channels are available.

In Resort Issues

Pre season and ongoing health and safety checks on all our listed properties are the sole responsibility of the villa/property owners. It is our understanding that the villas/properties conform to all local Spanish regulations. If you experience a problem with any aspect of your accommodation and/or identify any issue that you feel needs immediate attention, you must inform your service provider immediately, this being the owner, manager or other contact given for the accommodation at the time of booking.

Health

The main hospital in Ibiza is National Health, so it is strongly advisable to carry a completed E111 in order to benefit from the EU Reciprical Health Care Agreement. This is not however a substitute for adequate travel insurance which is essential and strongly recommended.

Passports and Visas

All travellers must be in possession of a valid 10 year passport. Everyone including children and newborn babies (who were not on a valid passport before October 5th 1998) must have their own inidvidual passport to travel abroad. Children under 16 years who were included on an adult's passport may not travel unless accompanied by that adult. If you are unsure of visa requirements from your country of origin you should check visa regulations with the Spanish Consulate and also with the consulates of any other countries that you will be passing through by road rail or boat.

Online Payments

All transactions online are safe and secure. Customers can choose to pay online using two methods, Telebanco 4B and Paypal. There is no need to have a Paypal account to use this service. Transactions through Paypal will show on your statement as ' CLUTCHTIME SL ', our official merchant name. Transactions through Telebanco 4B are for credit cards only and will show as everythingIbiza.com on your statements. All our prices are quoted in euros. Fees for the use of online transactions will be displayed in the shopping cart prior to booking. Accommodation purchases are subject to final confirmation within 48 hours of payment made and received by everythingIbiza.com ( CLUTCH TIME SL ). All accommodation bookings will be confirmed within this time period by email. * See notes below.

Cancellation & Refund Policy

Refunds

All refunds, be it part or full, will be dealt with on an individual basis. Our terms and conditions will be excersised before any full or part refund is made. Refunds made through Telebanco 4B will show on your credit card statement as everythingIbiza.com. Refunds made through Paypal will show on your statement as CLUTCH TIME SL. Should the need to refund arise, this process can be completed swiftly through electronic process with full security on the refund transaction.

Cancellations

It is industry best practise that you take out a travel insurance which covers cancellation of your accommodation. This is strongly recommended.

Accommodation Refunds - Hotels, Hostels & Apartments

If you cancel more than 7 days before your arrival, all payments will be refunded in full. If you cancel less than 7 days before your arrival or if you don't show, you will be charged for the first night.

Accommodation Refunds - Villas

If you cancel more than 60 days before your arrival, all payments will be refunded in full. If you cancel less than 30 days and more than 7 days before your arrival, you will be lose half of the deposit paid. If you cancel less than 7 days before your arrival or if you don't show, you will lose the deposit paid. ALL CANCELLATIONS, WITHOUT EXCEPTION, MUST BE RECEIVED BY US IN WRITING BY LETTER, BY EMAIL OR BY FAX.

Emails MUST be sent to info@everythingibiza.com. Faxes MUST be sent to: 00 34 971  80 34 90. Letters must be sent to our San Antonio Townshop. The address can be found in the OUR SHOPS section of the website. It is imperative to clearly state your confirmed booking reference that you received from us on booking your accommodation. It is included in the confirmation email. Your cancellation will require written confirmation from us either in the form of an email or a fax.

Booking Changes

Minor Changes by everythingIbiza.com before travel

Any changes which is not deemed to be significant, as outlined I the section entitled “changes made by us before travel” will be classed as a minor change. We will endeavour to tell you about a minor change before travel however, we will not pay compensation as a result of this change.

Circumstances beyond our control

Except where we say differently elsewhere in these conditions, we can not pay and compensation, reimburse expenses, or cover losses for any amount or otherwise accept responsibility if, as a result of circumstances beyond our control, we have to change your holiday after departure, or we, or our suppliers, cannot supply your holiday, as we, or they had agreed, or you suffer any loss or damage of any description. When we refer to circumstances beyond our control, we mean any event that we, or the supplier in question, could not foresee or avoid, even after taking all reasonable care. Such circumstances will usually include, but are not limited to, war, terrorist activity, civil unrest, industrial dispute, bad weather (actual or threatened) and significant building work ongoing outside your accommodation, which is not known to us in advance of your departure date and building work from a third party (such as resort development)

Changes made after travel

If, after your departure, a significant part of your pre-booked holiday arrangements can not be provided, you will be offered a suitable alternative if possible. If it is not possible to offer you a suitable alternative or, for good reason, you do not accept the alternative arrangements, we will return you to the place of your departure. If appropriate, we will also pay you compensation, unless your return has been due to circumstances beyond our control. The amount of compensation will be reasonable, taking account of all the circumstances.

Cancellation by everythingIbiza.com ( CLUTCH TIME SL )

We can cancel your holiday and any other holiday we operate. On rare occasions, we may need to cancel your holiday if there has been insufficient demand for your particular holiday. If we have to cancel a holiday for any particular reason, we will tell you as soon as reasonably possible. In these circumstances, we will, if we are able to do so, offer you an alternative holiday of equivalent or closely similar standard and price at no extra cost, but if it is less expensive holiday, we will refund the difference in price. If you do not wish to take the alternative we offer you, you can choose another holiday from us and pay, or receive a full refund of any price difference. Or, if you prefer, you can receive a full refund of any money you have paid to us, except for any amendment charges. We will not cancel your holiday within 8 weeks of departure except if we are forced to do so because of unusual circumstances we could not have foreseen, where we could not avoid the results of those circumstances even after taking all reasonable care (see “circumstances beyond our control”) No compensation will be payable in these circumstances, whenever they happen, and we will only have to offer you the above choices. We can also cancel if you fail to make payment for your holiday on time.
