Des d\u00e9bats controvers\u00e9s ont eu lieu de part et d'autre et, malgr\u00e9 les efforts de Theresa May, il semble de plus en plus probable que le Royaume-Uni quitte l'Union europ\u00e9enne sans l'accord insaisissable et favorable recherch\u00e9 par les politiciens et la Grande-Bretagne dans son ensemble. Il est encore temps, bien s\u00fbr, de trouver un accord, alors croisons les doigts et les orteils !<\/p>\r\n<p>Les chefs d'\u00c9tat et de gouvernement de l'UE, Jean-Claude Juncker et Donald Tusk, ont tous deux insist\u00e9 sur le fait qu'il ne fallait pas ren\u00e9gocier l'accord de retrait lors des derni\u00e8res r\u00e9unions du mois. La perspective d'un Brexit sans accord est susceptible d'affecter divers aspects de la vie au Royaume-Uni et, en fait, en Europe, mais quel serait l'impact sur les propri\u00e9taires britanniques de biens immobiliers espagnols ?\u00a0<\/p>\r\n<p>Tout d'abord, il convient de faire une distinction importante entre les r\u00e9sidents espagnols et les non-r\u00e9sidents. Toute personne vivant en Espagne plus de 183 jours par an a l'obligation de soumettre une d\u00e9claration fiscale espagnole l'ann\u00e9e suivant son arriv\u00e9e, entre mai et juin. Si un ressortissant britannique est un r\u00e9sident permanent espagnol, c'est-\u00e0-dire s'il a v\u00e9cu plus de 183 jours en Espagne, s'il est devenu r\u00e9sident en s'inscrivant aupr\u00e8s de sa mairie avant le 29 mars 2019 et s'il a soumis une d\u00e9claration d'imp\u00f4ts, les taux d'imposition sur les revenus et les successions, sur les revenus et les biens mondiaux, resteront probablement inchang\u00e9s.<\/p>\r\n<p>En cas de Brexit sans accord, le gouvernement espagnol s'est engag\u00e9 aupr\u00e8s des citoyens britanniques en d\u00e9clarant.. : <strong><em>\"fournir une solution qui, en tout \u00e9tat de cause, garantisse la s\u00e9curit\u00e9 juridique des citoyens britanniques et des membres de leur famille r\u00e9sidant en Espagne avant la date de sortie\".<\/em><\/strong><\/p>\r\n<p>Les investisseurs qui souhaitent acheter une propri\u00e9t\u00e9 espagnole en tant que r\u00e9sidence secondaire et qui n'ont pas l'intention de passer plus de 183 jours en Espagne seront consid\u00e9r\u00e9s comme des non-r\u00e9sidents fiscaux propri\u00e9taires d'une propri\u00e9t\u00e9 espagnole. \u00c0 ce titre, les co\u00fbts d'achat resteront les m\u00eames. Actuellement, un acqu\u00e9reur am\u00e9ricain d'une propri\u00e9t\u00e9 espagnole paierait les m\u00eames frais d'achat qu'un acqu\u00e9reur fran\u00e7ais ou britannique. Cependant, un an apr\u00e8s l'achat d'une propri\u00e9t\u00e9 en Espagne, un propri\u00e9taire non r\u00e9sident de l'UE ou de l'EEE serait redevable de l'imp\u00f4t sur le revenu des non-r\u00e9sidents (NRIT), un imp\u00f4t national sur la propri\u00e9t\u00e9 immobili\u00e8re en Espagne. (Imp\u00f4t sur le revenu des non-r\u00e9sidents). Cet imp\u00f4t s'applique que la propri\u00e9t\u00e9 soit lou\u00e9e ou non.<\/p>\r\n<p>L'imp\u00f4t sur le revenu des personnes physiques est calcul\u00e9 sur la base de la valeur cadastrale de la propri\u00e9t\u00e9. La base imposable est de 2% de la valeur cadastrale de votre propri\u00e9t\u00e9 ou de 1,1% si la valeur cadastrale a \u00e9t\u00e9 r\u00e9vis\u00e9e apr\u00e8s le 1er janvier 1994. Cette base imposable est ensuite multipli\u00e9e par le taux d'imposition appropri\u00e9. Actuellement, les ressortissants de l'UE paient 19%, tandis que les propri\u00e9taires non europ\u00e9ens de biens immobiliers espagnols paient 24%. En cas de Brexit sans accord avec l'UE, les propri\u00e9taires britanniques seront tr\u00e8s probablement redevables du taux le plus \u00e9lev\u00e9 de 24%.<\/p>\r\n<p>Personne ne peut pr\u00e9dire avec pr\u00e9cision ce qui se passera sur un march\u00e9 immobilier espagnol post-Brexit, mais il y a encore beaucoup de propri\u00e9taires britanniques qui profitent de leur maison de r\u00eave en Espagne.
