Aan alle kanten zijn er controversi\u00eble debatten gevoerd, en ondanks de inspanningen van Theresa May wordt het steeds waarschijnlijker dat het Verenigd Koninkrijk de Europese Unie zal verlaten zonder het ongrijpbare, gunstige akkoord waarnaar politici en Groot-Brittanni\u00eb als geheel streven. Er is natuurlijk nog tijd om tot een akkoord te komen, dus duimen maar!<\/p>\r\n<p>EU-chefs Jean-Claude Juncker en Donald Tusk waren tijdens de laatste vergaderingen deze maand allebei onvermurwbaar: er mag niet opnieuw worden onderhandeld over de terugtrekkingsovereenkomst. Het vooruitzicht van een \"no deal\" brexit zal waarschijnlijk gevolgen hebben voor verschillende aspecten van het leven in het VK en in Europa, maar wat voor gevolgen heeft dit voor Britse eigenaars van Spaans onroerend goed?\u00a0<\/p>\r\n<p>Ten eerste moet een belangrijk onderscheid worden gemaakt tussen Spaanse ingezetenen en niet-ingezetenen. Iedereen die meer dan 183 dagen per jaar in Spanje woont, is verplicht het jaar na aankomst tussen mei en juni een Spaanse belastingaangifte in te dienen. Als een Brits onderdaan een Spaanse permanente inwoner is, d.w.z. meer dan 183 dagen in Spanje heeft gewoond, inwoner is geworden door zich v\u00f3\u00f3r 29 maart 2019 in te schrijven bij zijn gemeente en een belastingaangifte heeft ingediend, blijven de tarieven voor inkomsten- en successierechten, over het wereldwijde inkomen en vermogen, waarschijnlijk ongewijzigd.<\/p>\r\n<p>Mocht er een \"No Deal\" Brexit komen, dan heeft de Spaanse regering een belofte gedaan aan de Britse burgers door te verklaren dat: <strong><em>\"een oplossing te bieden die in ieder geval de rechtszekerheid garandeert van de Britse burgers en hun familieleden die v\u00f3\u00f3r de uitreisdatum in Spanje verbleven\".<\/em><\/strong><\/p>\r\n<p>Investeerders die een Spaans onroerend goed willen kopen als tweede huis en niet van plan zijn meer dan 183 dagen in Spanje door te brengen, worden beschouwd als een niet-Spaanse belastingplichtige eigenaar van Spaans onroerend goed. Als zodanig zullen de aankoopkosten hetzelfde blijven. Momenteel betaalt een Amerikaanse koper van Spaans onroerend goed dezelfde aankoopkosten als bijvoorbeeld een Franse of Britse koper. Een jaar na de aankoop van Spaans onroerend goed zou een eigenaar die geen lid is van de EU of de EER echter onderworpen zijn aan de NRIT, een nationale belasting op Spaans onroerend goed. (Inkomstenbelasting voor niet-ingezetenen). Deze belasting is van toepassing ongeacht of de woning wordt verhuurd of niet.<\/p>\r\n<p>De NRIT wordt berekend op basis van de kadastrale waarde van het onroerend goed. De belastbare grondslag is 2% van de kadastrale waarde van uw eigendom of 1,1% indien de kadastrale waarde na 1 januari 1994 werd herzien. Deze belastinggrondslag wordt vervolgens vermenigvuldigd met het toepasselijke belastingtarief. Momenteel betalen EU-onderdanen 19%, terwijl niet-EU-eigenaren van Spaans onroerend goed 24% betalen. Als er een No Deal Brexit met de EU komt, zullen Britse eigenaren hoogstwaarschijnlijk het hogere tarief van 24% moeten betalen.<\/p>\r\n<p>Niemand kan precies voorspellen wat er zal gebeuren op een Spaanse vastgoedmarkt na de Brexit, maar er zijn nog steeds veel Britse eigenaren die genieten van hun droomhuis in Spanje.
